PUWER Regulations

PUWER stands for the Provision and Use of Work Equipment Regulations 1998, which is a UK law that places duties on businesses and organisations to ensure that work equipment used by their employees is safe, properly maintained, and suitable for its intended purpose. The regulations are designed to protect employees and others from the risks associated with the use of machinery and equipment at work.

Key Requirements of PUWER:

  • Suitability of Equipment:
    • Employers must ensure that any equipment provided for use at work is suitable for the intended purpose. This means that the equipment should be appropriate for the task, in good condition, and safe to use.
  • Maintenance of Equipment:
    • Work equipment must be maintained in an efficient state, in efficient working order, and in good repair. Regular inspections and maintenance schedules should be in place to prevent equipment from becoming hazardous.
  • Inspection of Equipment:
    • PUWER requires that work equipment is inspected after installation and before first use, and at regular intervals thereafter, to ensure it remains safe. Inspections should be carried out by competent individuals, and records of inspections should be kept.
  • Training and Competence:
    • Employers must ensure that employees using work equipment have received adequate training for the correct and safe use of the equipment. This includes understanding the risks associated with the equipment and how to avoid them.
  • Guarding and Safety Devices:
    • Dangerous parts of machinery must be guarded or fitted with safety devices to prevent access to hazardous areas or to stop the machine if access occurs. This includes emergency stop buttons and protective barriers.
  • Ergonomics and Human Factors:
    • The design and use of work equipment should take into account ergonomic principles to reduce the risk of injury. This includes ensuring that equipment controls are easy to reach and operate.
  • Markings and Warnings:
    • Work equipment should be clearly marked with any necessary warnings or instructions for safe use. This includes safety signs, labels, and operating instructions that are easily understandable by all users.

    • PUWER applies to a wide range of work equipment, including machinery, appliances, apparatus, tools, and any other equipment used at work. It covers everything from hand tools to complex machinery and from mobile equipment to lifting equipment.

    • PUWER is applicable across all industry sectors, including construction, manufacturing, agriculture, and services. Any workplace where employees use equipment will be subject to PUWER requirements.
